The Estonian transport and transit industry is strongly linked to the respective Russian, Dutch, and Scandinavian industries. Although the volume of goods and services in the sector has decreased during recent  years along with the global economic situation, Estonia’s good geographical position and infrastructure availability are advantages for trading and exchanging goods, developing transit, and attracting financiers in the area.

Our transport and transit practice includes legal advice on all aspects of carriage, transportation, and storage of goods by road, rail, sea, and air.  Our professional background also includes assistance on sale-purchase of aircraft, vessels, and rolling stock covering financing, registering, and managing means of transportation.

Our clients have been in need of legal assistance in issues associated with freight, infrastructure fees, and ground handling matters. In addition, the office’s expertise covers counselling clients operating oil terminals and storage of various oil substances.

Apart from financing and agreement arrangements, we have also  advised companies operating in the sector on all public procurement procedures and represented clients in disputes regarding competition, environmental protection, and white collar crime.

Some of our recent assignments include:

  • advising the Estonian subsidiary of Globaltrans Investment (Spacecom) in a dispute regarding rail infrastructure tariffs;
  • advising national aviation carrier Estonian Air in connection with lease agreements of airplanes;
  • advised a consortium of banks on reorganizing loans of NASDAQ OMX Tallinn listed company, TALLINK;
  • advising Trafigura, a leading commodities trader, on establishing a Dutch-Estonian joint venture operating the transportation and storage of oil and similar substances in Estonian, Russian, and Scandinavian major ports. Our assignment included structuring corporate organisation and daily business governance, drafting a shareholders’ agreement, mapping and assisting on employer-employee relations according to applicable regulations, and merging the activities of various regions into one holding company;
  • advising a private client on the purchase of a Learjet 31A-182. Our assignment covered legal advice on bringing the plane, transaction documentation, and technical requirement regulations into compliance with European Union standards and directives regarding importation of the aircraft from the United States.
